Separate the Ship House frontage from the rear Battersea warehouse range
Wandsworth’s Battersea Square appraisal distinguishes the former granary shop and offices at Ship House from warehouse buildings behind them. It describes stock brick, red-brick and terracotta detail, and metal-framed windows at the frontage. For a commercial lease within an adapted industrial group, obtain current plans identifying the actual building and floors. A historic trading address cannot establish a single present demise or repairing responsibility. Mark the frontage, rear ranges, connecting openings and shared access before attributing an alleged breach to the instructed tenant.
Supply the condition schedule, alteration licences and drawings for the tenant’s fit-out. Where a partition, internal connection or services route crosses between ranges, establish the document governing that work and the premises to which it relates. Distinguish reinstatement of a tenant alteration from repair of the retained industrial fabric. A continuous roof or courtyard does not itself establish common ownership or a tenant’s duty to repair the whole group. The technical schedule should locate the component and available evidence, leaving disputed legal interpretation to the appropriate adviser.

Record the retained Battersea materials and installations individually
For premises within the former granary setting, identify the actual brickwork, decorative detail and window system before choosing a repair method or cost. The appraisal supplies character evidence, not a current condition survey. Record the defect observed, the proposed remedy and any investigation needed where the construction is concealed. A replacement allowance should explain its extent and why a lesser repair is insufficient. Tenant signage, internal finishes and equipment should retain separate document references so they are not absorbed into a general heritage-fabric item.
At Cotswold Mews, the appraisal identifies the former laundry and surviving courtyard chimney as an industrial-history feature. If an instruction involves a comparable retained structure, identify its actual relationship to the demise and the limits of available inspection. Do not estimate an unseen upper component solely from a ground-level historic description. An interim schedule, terminal assessment and final inspection after agreed work should record their different dates and circumstances. The RICS professional standard provides the reporting framework for schedules and responses; the claim still needs the relevant covenant, condition evidence, remedy and cost basis for each item.

Compare a Battersea refurbishment proposal with the claimed repairs
The appraisal describes the former Sir Walter St John’s School as a red-brick group developed through later extensions and differing details. That example shows why a larger building can contain several construction phases. For the actual leased premises, request the landlord’s proposed works by range and phase, with the drawings and decisions supporting them. A plan to replace one section does not establish the treatment of every roof, opening or installation. Identify retained fabric and the particular tenant work that the proposal removes, rather than assuming an industrial or institutional origin proves a wholesale redevelopment intention.
Section 18(1) addresses repairing-covenant damages through the diminution limit and its separate provision concerning demolition or structural alterations where the stated conditions apply. Other lease obligations require their own analysis. If a party alleges supersession, name the repair and the intended operation that would make it unnecessary, supported by the chronology. Appropriate legal and valuation input may be needed. The Quantified Demand should explain the supported landlord loss rather than simply repeat the schedule’s repair total. Neither the Battersea location nor a broad redevelopment narrative establishes that loss for a particular tenancy.

Substantiate courtyard and access allowances in the Battersea claim
Wandsworth records granite setts in the courtyard associated with the former granary buildings. For a repair using that setting, establish the actual surface, condition and proposed loading before treating it as a scaffold base, delivery position or materials store. Photographs cannot demonstrate load capacity or access rights. Obtain the necessary technical advice and permissions, and describe protection and reinstatement in the estimate. The existence of a yard is not evidence that it is available to the tenant’s contractor or that every expense associated with it is recoverable.
Show the complete route from unloading to the affected frontage, rear range or retained structure. Identify any restriction controlled by another occupier and whether the method is agreed or provisional. If the working arrangement changes, connect the revised cost to the measured finding and relevant repair item. The applicable Dilapidations Protocol provides the process for exchanging schedules, Quantified Demands and responses in commercial termination claims. A useful Battersea instruction identifies the client’s position, precise demise, tenancy stage, available documents and decision deadline, allowing scope, condition, access and loss issues to be considered separately.

Battersea lease-end questions
Does Ship House’s historic address establish the extent of a commercial lease?
No. The appraisal distinguishes frontage buildings from rear warehouses, while current ownership and tenancy arrangements require their own documents. Obtain the executed demise plan and present layout, including shared connections and access, before attributing repairs to one tenant across the whole group.
Can a retained Battersea chimney be priced from an appraisal photograph?
The historic account identifies a feature, not its present condition or repair specification. Establish whether it falls within the relevant obligations, what inspection is available and what competent investigation is required. A cost allowance should state the actual technical and access assumptions behind it.
Can the courtyard automatically be used for scaffolding or materials?
Confirm control, permission, surface condition and suitability for the proposed operation. Granite setts in a historic record do not establish load capacity or a right of occupation. Keep the method and protection costs separate from the legal question of the tenant’s liability for those expenses.
How does a phased Battersea redevelopment affect a terminal claim?
Compare the documented proposal with the individual ranges and components in the schedule. Identify what would be retained, removed or replaced and when. A scheme affecting one phase should not be assumed to supersede all repairs elsewhere; obtain the relevant legal and valuation advice on the evidence.
