Planning the Highgate major works brief
For a Highgate block, start by identifying the exact property, the authority responsible for the relevant planning record and the client entitled to commission shared repairs. HCS can support inspection, specification and tender questions. A useful consultation pack explains the building’s uncertainties before turning them into a priced programme for leaseholders.
Confirm the authority and the limits of the historic evidence
Camden’s Highgate appraisal states that the village extends across Camden, Haringey and Islington and distinguishes Camden’s conservation area from the Haringey designation. It also notes that later-looking buildings can conceal earlier fabric. These are reasons to verify the address and investigate carefully; they are not evidence that every Highgate block contains a particular historic structure.
Keep the relevant designation map, listing information where applicable and available alteration records with the brief. Record which parts of the proposed work need specialist design or consent advice. An inspection should identify accessible elements and its limitations. Avoid treating a conservation-area label as proof either that a repair is permitted or that the existing material has failed.
Separate visible deterioration from concealed uncertainty
For a converted Highgate house, a defect visible in one room may relate to a component shared with other homes. Record the reported history, inspected location and evidence supporting the diagnosis. If the cause is not established, define a proportionate investigation rather than placing a confident repair description into the consultation documents prematurely.
Where opening-up is recommended, say what result would change the proposed solution. The client can then understand whether the next commission is an investigation, a design decision or the permanent works. Keep alternative treatments and their limits visible. Neither the apparent age of a building nor a description in the local appraisal supplies the missing condition evidence for a shared roof, wall or drainage system.
Make the shared repair boundary clear to the notice issuer
The landlord’s team should identify the proposed works and the relevant contributions from the actual leases. A division of the total bill by the number of flats is not a substitute for checking unequal shares or separate schedules. On a property with successive alterations, ask whether the title and management information reflects the current arrangement before deciding who should receive information.
HCS can provide technical descriptions, measured scope and tender clarification. The client or managing agent must determine and operate the applicable consultation route with legal help where needed. For ordinary qualifying works, nominations, estimates and responses should be tied to a consistent specification. A conversation about a repair preference should be recorded as an observation, not silently treated as an instruction to the contractor.
Plan investigation and procurement as linked decisions
Identify when access can be obtained, who will arrange it and which decision depends on the resulting evidence. If a repair needs a design or permission decision, allow for that before the relevant work is ordered. Give tenderers the same known constraints and ask them to identify assumptions that could alter their prices or proposed duration.
When an urgent problem changes the sequence, retain the contemporaneous evidence and reasons for immediate action. Do not imply that urgency automatically removes the consultation requirement. Advice on section 20ZA dispensation should address the actual events, possible prejudice and conditions. The technical team’s account can support that advice, while the tribunal determines an application and the landlord remains responsible for its recovery position.
Specify the boundaries of a Highgate appointment
A quotation request should identify the client, exact address, inspection access, available reports and the point already reached in consultation. Set out whether HCS is asked to investigate, prepare a schedule, evaluate tenders or administer the later contract. The need to coordinate historic fabric advice or examine earlier alterations can change the agreed task.
Identify reports and specialist input that are excluded or commissioned separately. Where residents want independent scrutiny, establish the conflict position and the question to be answered before assuming that an adviser already working for the landlord can take their instruction. Professional fee proposals should describe deliverables; legal interpretation and notice preparation are not silently included in a technical surveying appointment.
Section 20 thresholds and responsibilities
For England, qualifying works trigger consultation when any one leaseholder’s relevant contribution is more than £250. For a qualifying long-term agreement, the test is more than £100 for any one leaseholder in an accounting period. Such an agreement has a term of more than 12 months, subject to the statutory definition and exclusions. Check the highest actual contribution under the leases, including VAT where payable, rather than relying on the average for the block.
Thresholds effective from 31 October 2003; statutory sources checked 1 October 2026. This source check is separate from the page’s human review date.
Sources: qualifying works amount, agreement amount and accounting period, agreement definition and commencement.
Reform watch: Government has consulted on raising the thresholds and a draft Leasehold and Commonhold Reform Bill was published in January 2026. Government consultation; draft Bill. Check the current law before relying on a proposed change.
HCS does not prepare or serve statutory Section 20 notices. HCS provides the specification, tender information and consultation support the landlord or managing agent needs. The notices are issued by the landlord or agent, with their solicitor where required. HCS does not give legal advice.
Where HCS specifies, tenders or administers a Section 20 programme, HCS will not also tender as contractor.

Highgate major works questions
Does Highgate always mean Camden for a repair application?
No. The official appraisal identifies several borough relationships. Check the precise address and the relevant authority’s current records before relying on a designation or permission route. A neighbourhood name is not a planning boundary.
Can the works be described before a concealed defect is investigated?
Describe what is known and make the uncertainty explicit. If an investigation is necessary to choose the permanent repair, define that first task and its intended decision. Ask the consultation adviser how the developing scope should be handled rather than presenting an unsupported final solution.
Is a technical review the same as disputing the service charge?
No. A scoped review can examine condition evidence, quantities and tender assumptions. Lease interpretation, liability, tribunal procedure and the legal reasonableness of a demand need the relevant advice. Confirm the requested role and any conflict before instruction.
