Separate Colville shop parades from the Powis Mews studio brief

RBKC's adopted Colville appraisal records shop parades with upper accommodation on All Saints Road and identifies a different history at Powis Mews, where the western former stables became Boundary Warehouse and later contained residential and business studios. These are named historical examples within Kensington and Chelsea, not a current occupier directory or a uniform specification for commercial units. A dilapidations instruction should identify the particular premises and present arrangement on its lease plan. Distinguish the trading or studio accommodation from neighbouring homes, common entrances and shared structure before assigning an inspection boundary or a repair item to the tenant.

For a unit formed within an adapted range, obtain the documents showing what the tenant received and what changed during occupation. Label original walls and openings separately from later partitions, raised floors, fitted equipment or other installations where the records support that distinction. A broad description such as studio fit-out can conceal several separate obligations. Reinstatement questions need the relevant licence, lease wording and notice position considered for each identified alteration. The historic account does not prove that a current tenant installed a feature, that every change requires removal or that the whole former warehouse forms one demise.

Keep frontage, upper-floor and studio repair items distinct

At an All Saints Road-side shop, locate the shopfront, entrance, ceiling interface and relevant services independently from the accommodation above. The apparent continuity of a facade does not establish one repair covenant or unrestricted access through every floor. Describe the observed problem and the proposed remedy at its component, including any limitation on viewing concealed support or a shared roof. In a Powis Mews unit, use the conversion documents to distinguish retained fabric from inserted work. Repair, decoration and reinstatement should remain separate categories in the schedule so that their evidence and contractual bases can be answered clearly.

Agree whether the instruction concerns an interim position during occupation, a terminal schedule near expiry or a final inspection after handover and remedial work. Use dated plans and photographs to show which state was actually examined. RICS dilapidations guidance addresses the preparation of schedules, responses and related claim documents; a local character appraisal is not a substitute for that property-level assessment. Mechanical and electrical installations need an agreed inspection scope, equipment references and available maintenance records. Where specialist testing is necessary, identify it expressly rather than implying that a general fabric inspection has verified every concealed system in the leased accommodation.

Test a borough refurbishment proposal against the actual leased unit

The borough publishes separate adopted appraisals and management documents for its conservation areas. A proposal affecting Colville premises should therefore use the applicable address record rather than a repair or consent assumption imported from another Kensington and Chelsea property. Request the landlord's actual plans for the unit, including proposed changes of layout, use or specification. A possible conversion or a general regeneration narrative is not proof that works will proceed. Identify which claimed components would remain in service and which the evidenced scheme proposes to replace, recording the programme and decisions relied upon when considering whether an item would be superseded.

Section 18(1) limits damages for breach of a repairing covenant by the resulting diminution in the value of the reversion. It also addresses demolition or structural alterations at or shortly after lease termination that would make the relevant repairs valueless. This is not an automatic cap on every category of a dilapidations claim. Obtain the appropriate legal and valuation assessment for the facts. Supersession should be considered against the landlord's evidenced intentions and the particular work claimed; a repair-cost total is not, by itself, proof of the loss to be demanded.

Identify which RBKC access requirements the priced remedy actually needs

RBKC's construction code distinguishes site categories, while its traffic guidance addresses the relationship between a required construction traffic management plan and subsequent permits or licences. Establish the route applicable to the actual proposed remedial work rather than assume that every lease-end decoration job has the same requirements as a major refurbishment. Price the agreed working position, protection, delivery and waste arrangements with their supporting assumptions. Private access through another unit remains a separate matter. If an allowance depends on a council decision, identify the outstanding requirement and its effect instead of presenting an unconfirmed method as a settled claim cost.

A Quantified Demand should explain the monetary loss supported by the schedule, including the documentary basis for costs and any additional heads sought. Keep estimates, invoices, work scopes and landlord-intention papers connected to the same premises references. The tenant's response can then identify whether the dispute concerns the covenant, condition, remedy, quantity, rate or effect of a later scheme. Do not combine different borough sites into one unexplained total simply because they share an owner. Retain a separate chronology and negotiation record for each property so that a local permission issue or building constraint is not attributed to the wrong commercial lease.

Kensington and Chelsea lease-end questions

Does the Colville appraisal identify today's commercial occupiers?

No. It provides historical building and use context for named locations. Establish the current premises, occupation and lease boundaries from the property documents and inspection; do not treat a recorded studio or shop use as a current tenancy register.

Should a Powis Mews schedule cover the complete former warehouse?

Only the agreed premises and relevant obligations should be assessed. Use the lease and conversion plans to identify the unit, shared fabric and access limits. A historical range can contain interests that require separate consideration.

Does a Kensington and Chelsea conversion proposal establish supersession?

Obtain the actual scheme, decision dates and evidence of intention, then compare its effects with the claimed works. A possible change of use or broad policy context is not enough to determine the landlord's loss or the repairing-covenant limit.

Can one RBKC access allowance be used for several lease-end claims?

Each premises needs its own method, scope and relevant permission assumptions. A major scheme's arrangements should not be transferred automatically to a smaller remedial job or another address; substantiate the costs against the work actually claimed.
