Employer's Agent London

Employers agent London: design-and-build appointment and project-stage control

An employer's agent represents the client's interests on design and build projects — managing the employer's requirements, the contractor's proposals, change control and delivery so the building delivered is the building briefed.

We advise developers, housing providers, schools, freeholders and commercial clients where design, cost, quality and programme need active client-side control. We are independent of the contractor, which is what protects the client's position on a design and build contract.

Before You Instruct

What to send, and what you receive

Outline the building and the works and we will set out how we can support delivery and a fee before you instruct.

What to send before we quote

  • The building address and postcode
  • The proposed works
  • Any existing surveys or specifications
  • Leaseholder or funding constraints
  • Your target programme

What you receive

  • A clear scope of our role and deliverables
  • Documents suited to the stage (for example specification, tender or contract administration outputs)
  • Independent oversight and reporting through delivery

Where specialist designers or engineers are needed, we set out the gaps and coordinate the right input. Ask what the report would include.

When To Instruct Us

When to appoint an employer's agent

Clients usually come to us when a design and build project needs client-side control, not for a role title. These are the typical triggers.

  • A project is being procured on design and build.
  • You need clear employer's requirements before tendering.
  • A contractor's proposals need reviewing against the brief.
  • A development needs client-side delivery control.
  • Design novation needs coordinating.
  • Change and provisional sums need controlling.
  • Practical completion criteria need defining up front.
  • You want independent oversight separate from the contractor.
London Context

Design and build projects need clear employer's requirements

London development and refurbishment projects face planning constraints, access limitations, leaseholder interfaces and technical risk.

Well-drafted requirements and disciplined monitoring reduce the risk of ambiguity, late change and poor-quality delivery.

On a design and build project the employer's agent is the client's principal representative, and in London that role earns its keep in the detail. Planning constraints, restricted access, leaseholder and neighbour interfaces and technical risk all create room for ambiguity, and once the contractor holds design responsibility, anything left vague in the employer's requirements tends to be resolved in the contractor's favour. We help define clear, complete employer's requirements at the outset, review the contractor's proposals against them, administer the building contract, manage payment and change, and monitor progress and quality through to handover. Acting only for the client, we keep the requirements, the contract and the delivery aligned, so the finished building matches what was specified and change is controlled rather than absorbed late and at a premium.

Our process

How an Employer's Agent appointment works

Employer's Agent is the design-and-build equivalent of contract administrator. The role manages the contractor on the employer's behalf through a JCT Design and Build contract or equivalent.

1. Employer's Requirements drafting

Robust Employer's Requirements are the foundation of any successful D&B project. We draft, review and challenge the ER so the brief is unambiguous before tenders are sought.

2. Contractor's Proposals review

Detailed review of Contractor's Proposals against the Employer's Requirements, identifying deviations, qualifications and gaps before the contract is awarded.

3. Construction phase administration

Issue change orders, review and approve contractor design submissions, monitor progress, value monthly applications, certify payments and manage the change-control process.

4. Practical completion and final account

Verify completion criteria, manage defects-period correspondence, agree the final account and close out the contract formally.

Common issues

Common Employer's Agent issues we handle

The patterns below come up repeatedly in instructions across London. They guide where we focus inspection and reporting effort.

ER vs CP gaps

Where the Contractor's Proposals deviate from the Employer's Requirements, those deviations can be deemed accepted on contract execution. We catch and document deviations before commitment.

Design responsibility on D&B

Design responsibility sits with the contractor on D&B but can be qualified or transferred in places. We map design responsibility clearly so risk is allocated correctly.

Provisional sums and PC sums

Provisional sums and prime cost sums are common cost-certainty weak points. We test the contractor's allowances and recommend tightening up before contract.

Practical completion criteria

Defining practical completion clearly avoids end-of-contract disputes. We agree completion criteria with the contractor at contract stage, not when defects arise.

Professional Boundaries

What this role is — and is not

The employer's agent is an independent client-side role under a design and build contract, administering the contract on the employer's behalf. We do not carry out the design or the building work, which are the contractor's responsibility under design and build; our role is to define the requirements, review the proposals, control change and administer the contract.

We are not your solicitor: contract drafting and legal interpretation are legal matters and we work with your legal advisers. Where structural design, cost consultancy, clerk of works inspection or CDM duties are required, those are separate roles which we identify and coordinate rather than implying they are covered. We do not guarantee a project outcome; we administer the contract properly on the evidence.

Design And Build

The employer’s agent under a design and build contract

On a JCT Design and Build contract the design responsibility passes to the contractor, and there is no independent architect or contract administrator in the traditional sense. The client’s interests are instead represented by the employer’s agent, who administers the contract, values the work, manages change and certifies payment and completion — a role that demands both technical and contractual judgement because the agent is the client’s main line of protection.

The heart of a design-and-build job is the relationship between the Employer’s Requirements and the Contractor’s Proposals. The Requirements set out what the client must have; the Proposals are what the contractor offers to deliver for the price. Where the two conflict or fall silent, disputes follow, so the employer’s agent has to hold the contractor to the Requirements, scrutinise proposed changes and value them fairly, and keep the quality and specification from drifting under cost pressure.

Because the same contract carries the design risk and the delivery risk, the employer’s agent role rewards a surveyor who reads both the drawings and the contract. We keep the payment, change and completion record clear and defensible, protect the specification the client is paying for, and give early warning when the programme or the design is heading somewhere the Employer’s Requirements did not intend.

FAQs

Employer's Agent London FAQs

What does an employer's agent do?

An employer's agent acts for the client on a design and build project, administering the contract and protecting the client's interests. The role typically covers the employer's requirements, reviewing the contractor's proposals, change control, valuations and certificates, and managing completion and the defects period.

How is an employer's agent different from a contract administrator?

An employer's agent is the design and build equivalent of a contract administrator. The named functions overlap, but on design and build the contractor carries the design responsibility, which changes how the role is exercised, particularly around the employer's requirements and the contractor's proposals.

Is this the same as project management?

There is overlap, but employer's agent is a specific named role under design and build procurement, focused on the contract. Project advisory is the broader client-side leadership of the project. We can provide either or both under separate agreed terms.

Can you prepare the employer's requirements?

Yes. We can prepare or review the employer's requirements so the technical and performance brief is unambiguous before tenders are sought. A clear, well-drafted set of requirements is the single biggest factor in design and build cost and quality certainty.

Do you review the contractor's proposals?

Yes. We review the contractor's proposals against the employer's requirements, identifying deviations, qualifications and gaps before the contract is awarded, because unaddressed deviations can be deemed accepted on contract execution.

Do you monitor quality and progress?

Yes. Quality monitoring, progress review and reporting form part of the role. Where more intensive day-to-day quality inspection is needed, a separate clerk of works can be appointed alongside the employer's agent.

Do you work with novated design teams?

Yes. Design novation under design and build is one of the more complex transitions. The employer's agent role coordinates the novation, the design team's continuing duties and the contractor's design responsibility so the interfaces are clear.

Do you carry out the building works yourselves?

Not under this appointment. An employer's agent must remain client-side and independent of the contractor. If HCS holds the contractor appointment for a works package, HCS will not act as employer's agent for that package and the client must appoint a separate professional.

Can you support a design and build dispute if one arises?

Yes. We can support adjudication, mediation or expert witness work on design and build disputes, subject to conflict checks. Many such disputes turn on employer's requirements versus contractor's proposals deviations, which is exactly what the role exists to prevent.

Which contract forms do you act under?

We typically act under the JCT Design and Build Contract and similar design and build forms. The right form and any amendments depend on project size, design responsibility and risk allocation, which we advise on before the contract is let.

When should an employer's agent be appointed?

Ideally before the employer's requirements are finalised and tenders sought. The brief and the contractor selection are where design and build risk is won or lost, so early appointment gives the best control of cost, quality and programme.

Role Separation

HCS does not act as employer's agent for its own works

Where HCS provides the employer's agent role, the contractor must be independent of HCS. HCS will not act as the client's independent employer's agent while also holding the contractor appointment for the same works.
