Identify the City premises and shared-building obligations

The City Corporation's construction guidance recognises that residents, businesses and other sensitive premises can be affected differently by works. For a commercial handover instruction, identify the actual unit and neighbouring uses rather than assume the whole building is vacant or under one occupier's control. Read the executed lease and plan, amendments and any condition schedule, locating floors, external components, base-building services and shared areas. A City address does not establish responsibility for every installation serving the premises. Record the inspection boundary and current occupation so the schedule distinguishes a tenant obligation from work to a landlord-controlled system or another occupier's area.

Collect fit-out licences, dated plans and photographs for partitions, equipment, signs and service connections. Distinguish tenant additions from landlord provision and earlier installations before preparing reinstatement items. State the provision relied on, any notice condition and the making good at retained fabric, obtaining legal advice where terms are disputed. A management instruction or preferred future layout is not itself evidence of the contractual handover obligation. If the commencement or commissioning record is incomplete, identify the gap instead of assigning every current installation to the departing tenant. The costed scope should follow the actual component and evidence rather than a general office-clearance assumption.

Inspect the actual City fabric and record investigation limits

The Corporation describes the Barbican's residential blocks on a raised podium and highlights distinctive concrete detailing, with separate listed-building management guidelines. This is a specific City setting, not a description of every Square Mile commercial property or evidence of a lease at a named block. At the instructed premises, establish construction and observed condition directly. Locate each alleged breach and explain decoration, local repair or replacement with its supporting quantity. Where a concealed interface cannot be inspected, state the investigation and protection needed before a final remedy is defined. Neither a listed designation nor a modern appearance establishes deterioration or justifies wholesale renewal.

Keep the inspection date and lease stage explicit when an interim review develops into a terminal schedule or post-departure assessment. Use stable references to show tenant works completed between visits, revised findings and inaccessible components. Services need actual equipment, maintenance and testing evidence, with shared interfaces and scope limits recorded. RICS guidance provides the structure for schedules and responses linking obligations, alleged breaches, remedies and costs. It permits a question about base-building responsibility to be considered separately from the technical evidence for an installation's condition, the proposed intervention and the practical operation on which its cost is based.

Assess the City landlord’s actual fit-out or redevelopment proposal

If the landlord intends to replace a fit-out, change the floor layout or undertake a wider building project, obtain the actual drawings, decisions and anticipated timing. Identify components retained, altered or removed and compare that scope with the repair and reinstatement schedule. A City location does not prove demand for a particular use, an incoming occupier or permission for conversion. Separate a potential idea from evidenced intentions and record unresolved technical or planning matters. Where a quotation combines tenant-related work with landlord upgrades, distinguish those costs before treating the total as the financial consequence of the alleged breach at the particular premises.

Section 18(1) limits damages for breach of a repairing covenant by the resulting diminution in the value of the reversion. It also addresses demolition or structural alterations at or shortly after lease termination that would make the relevant repairs valueless. This is not an automatic cap on every category of a dilapidations claim. Obtain the appropriate legal and valuation assessment for the facts. Supersession should be considered against the landlord's evidenced intentions and the particular work claimed; a repair-cost total is not, by itself, proof of the loss to be demanded.

Support City protective-work and access allowances

City guidance explains that planning conditions often require a protective-works scheme addressing noise, vibration and dust, with detail depending on likely impact and approval before the restricted work begins. Check the actual conditions and operation rather than assume every small repair has identical requirements. Show loading, internal handling, temporary equipment, affected occupiers and system interfaces, identifying building-management and highway arrangements separately. A City postcode is not a permit, and a management approval does not provide private rights over another premises. Record protection, duration and reinstatement, disclosing outstanding decisions before a programme or equipment period is used in the cost account.

Support quantities, labour and hire periods with the relevant estimate or invoice. Allocate operations shared by several repair items transparently and distinguish access also required for a landlord improvement. An alternative tenant method needs comparable physical and permission evidence before its price is accepted as comparable. The terminal dilapidations protocol requires a substantiated loss account, which may differ from an initial works total. Retain lease references, condition and services records, alteration documents and landlord intentions beside itemised responses so negotiation can identify whether an unresolved difference concerns responsibility, repair extent, practical method or amount properly claimed.

City of London lease-end questions

Does a City commercial lease automatically cover all base-building services?

No. Examine the executed documents and actual installations, including shared and landlord-controlled systems. Identify the specific obligation and condition evidence for each item. The fact that a service supports the unit does not by itself establish the tenant's repair or replacement responsibility.

Does the Barbican example describe every City commercial building?

No. It is a specific local example of listed modern fabric. Establish construction, designation and condition at the instructed premises independently. Neither the example nor a building's modern appearance can determine a remedy, quantity or lease obligation elsewhere.

Does a proposed City refit remove every repair and reinstatement item?

Obtain the actual scheme, decisions and timing and compare it with each claimed component. Distinguish retained elements and improvements. Appropriate legal and valuation advice may be needed for repairing-covenant limits, diminution and any supersession issue affecting the loss.

What supports a protective-works allowance in a City claim?

Identify the actual conditions, affected activities and necessary measures, with the proposed method and approval status. Support quantities and duration with price evidence. A general reference to City guidance does not establish the same requirement or cost for every repair.
