Boundary survey London: measured plans, title evidence and dispute support

Most London boundary disagreements begin with a surprise: the registered title plan does not fix the exact legal boundary. Under the general boundaries rule in section 60 of the Land Registration Act 2002, a title plan shows the boundary’s general position — the precise line depends on the deeds, earlier conveyance plans, historic mapping and what has stood on the ground, read together. We act for owners, buyers and their solicitors across London, assembling that evidence into a clear, illustrated report before positions harden and costs escalate.

The Evidence

What actually determines a boundary

Registered titles and deeds

The registered titles on both sides, and the earlier conveyances they derive from. The first conveyance that divided the land, and any plan attached to it, usually carries the most weight.

Historic mapping and photographs

Ordnance Survey editions, estate plans and dated photographs showing what stood where, and when. Boundary features move; the record of when they moved matters.

The measured survey

An accurate survey of the disputed section ties the documents to the ground: existing features, offsets and dimensions overlaid against the title and conveyance plans at true scale.

Physical features and occupation

Fences, walls, hedges, outbuildings and long-standing use. What the parties and their predecessors actually treated as the boundary is itself evidence.

Routes To Resolution

Four ways a boundary question gets resolved

Most disputes settle on the evidence — the formal routes exist for the ones that do not.

Agreement between neighbours

A clear report often resolves the question directly. Where both owners agree the position, a boundary agreement can record it — proportionate, quick and neighbourly.

Determined boundary application

The Land Registration Act 2002 provides a route to apply to HM Land Registry to determine the exact line of the boundary, supported by a plan prepared to the registry’s standards. We prepare the measured survey and plan this application turns on.

Mediation

Where discussion has stalled, structured mediation with the evidence on the table resolves many disputes at a fraction of the cost of proceedings.

Expert evidence in proceedings

Where litigation is unavoidable, we provide CPR-compliant expert reports and can act as single joint expert — our duty in that role is to the tribunal, not to either party.

Boundary Or Party Wall?

When the question began with a neighbour’s works

Boundary ownership and party wall procedure are different legal questions that often arrive together. The Party Wall etc. Act 1996 governs notifiable works to shared structures, new walls at the line of junction and nearby excavation — it does not decide where the boundary is. If a notice, an extension or a rebuilt garden wall started the disagreement, we advise on both tracks: the works procedure under the Act, and the ownership evidence behind it.

How It Works

A boundary instruction, start to finish

01 — Document review

Send us the titles, any deeds and photographs, and what changed. We review the papers and tell you honestly whether the evidence looks clear, arguable or thin.

02 — Measured survey

We survey the disputed section and overlay the results against the title and conveyance plans at true scale, so the documents and the ground can be read together.

03 — Report and options

An illustrated report sets out where the evidence points and the proportionate routes open to you — agreement, determined boundary application, mediation or, where necessary, proceedings.

04 — Resolution support

We prepare determined-boundary plans, support solicitors and mediators, and where matters proceed, provide CPR-compliant expert evidence.

Fees

Fixed fees, quoted after the papers

Boundary instructions vary too much for a menu price to be honest: a single garden boundary with clean titles is a different exercise from a mews plot with layered conveyances. We review what you send first, then quote a fixed fee for the defined scope — document review, measured survey, report — before you commit to anything. Written professional terms on every instruction.

FAQs

Boundary dispute FAQs

Does my title plan show the exact legal boundary?

Usually not. Registered title plans are prepared under the general boundaries rule in section 60 of the Land Registration Act 2002: they show the general position of a boundary, not its exact line. That is why boundary questions turn on evidence — deeds, historic plans, physical features and measured survey — rather than on the title plan alone.

What does a boundary dispute surveyor actually do?

We assemble and test the evidence: the registered titles and any earlier conveyance plans, historic mapping, photographs, and the physical features on the ground, tied together with an accurate measured survey. The output is a clear, illustrated report setting out where the evidence points and what your options are.

Can the exact boundary line be fixed permanently?

The Land Registration Act 2002 provides a route to apply to HM Land Registry for a determined boundary, supported by a plan to the registry’s standards. Where both owners are in agreement, a boundary agreement can also record the position. We prepare the survey and plan evidence both routes rely on.

Is this the same as a party wall matter?

No, though they often arise together. The Party Wall etc. Act 1996 governs notifiable works to shared structures and at the line of junction; it does not decide who owns what. If your question began with a neighbour’s works, the party wall process and boundary evidence may both be relevant, and we advise on which applies.

Do boundary disagreements have to end up in court?

Most are resolved without litigation. A clear evidence base often settles the question directly; agreed positions can be recorded formally; and mediation is available where discussion has stalled. Where proceedings are unavoidable, we provide CPR-compliant expert evidence, including single joint expert appointments.

What should I send you first?

Your title number or address, any deeds or plans you hold, photographs of the disputed section, and a note of what changed — a new fence, an extension, a sale. We review what you send and reply within one working day with the sensible next step.

How We Investigate London Boundary Demarcation, Title Plans & CPR Part 35 Disputes

Resolving boundary disputes across dense London residential and commercial plots requires a rigorous understanding of why HM Land Registry title plans rarely establish exact linear dimensions on the ground. Under section 60 of the Land Registration Act 2002, the red edging on an official title plan indicates the general boundary only, plotted against Ordnance Survey MasterMap mapping whose positional tolerances in urban Victorian and Edwardian streets can vary by several hundred millimetres. When neighbours in Hampstead, Belsize Park, Highgate, St John’s Wood, Kensington, Chelsea, Islington or Richmond contest the line of a garden wall, side passage, flank extension, cornice overhang or basement footing, scaling off a 1:1250 Land Registry plan cannot by itself prove legal ownership or encroachment.

Our boundary dispute surveyors begin by reconstructing the root conveyance and historical transfer deeds that first carved the plot out of a larger estate, alongside historic Ordnance Survey County Series plans (1:1056 and 1:2500 editions), local authority building control archives, historic aerial photography and dated street-level imagery. We then carry out a high-precision total-station and GNSS/3D laser measured survey tied to permanent physical datum points—such as original Victorian party wall piers, surviving brick plinths, historic gateposts, cellar vaults and eaves lines—so that the paper title description can be overlaid accurately onto the current physical topography.

Where neighbours wish to formalise an agreed boundary line or apply to HM Land Registry under Practice Guide 40 (Supplement 4) for a Determined Boundary (Form DB1), we prepare the compliant high-accuracy determined boundary plan showing permanent physical reference markers to millimetre precision, supported by a surveyor’s technical statement. Where boundary works also engage the Party Wall etc. Act 1996—such as building a new wall on or astride the line of junction under Section 1, or excavating within three or six metres of an adjoining structure under Section 6—we clarify how statutory party wall rights interact with common-law boundary ownership so neither owner mistakes a Party Wall Award for a determination of title.

If litigation or First-tier Tribunal (Property Chamber — Land Registration division) proceedings are contemplated, we accept instructions either as a Single Joint Expert (SJE) or as a party-appointed Expert Witness in strict compliance with Part 35 of the Civil Procedure Rules (CPR Part 35) and the RICS Practice Statement Surveyors Acting as Expert Witnesses. Every CPR Part 35 report sets out the chronological chain of title plans, the physical aged-feature evidence on site, the range of professional opinion where historic deeds are ambiguous, and the surveyor’s independent declaration of truth to the court or tribunal. You can also review our published London surveying case studies and RICS inspection and reporting methodology for examples of how we document measured evidence.
